Starts Corporation Inc. / Privacy Policy

Starts Corporation Inc. and our group companies (hereinafter collectively the "Company ") recognize the importance of protecting and properly handling the Personal Information of customers, clients and job applicants, etc. (hereinafter collectively "Customers ") in the operation of the business of the Company and shall make every effort to manage and protect such information with the utmost care. This Policy establishes the Company’s basic policy on the protection and handling of such Personal Information. The ensuring of the proper handling of specific Personal Information and individual numbers pursuant to the "Act on Preparation, etc. of Relevant Acts Accompanying Enforcement of Act on Use, etc. in Administrative Procedures of Numbers to Identify Specific Individuals " ("My Number Act ") shall be governed by the separately established "Basic Policy on the Handling of Specific Personal Information ".

1. Definitions

  1. Personal Information means information relating to a living individual (name, gender, address, date of birth, telephone number, fax number, e-mail address, place of work, family status, contract details, details of leased property, portfolio assets and purchased insurances, etc.) which can on its own or in combination with other information distinguish or identify a Customer, symbols and codes into which physical features which can identify individuals have been converted (fingerprints, palm vein patterns, voiceprints, iris and facial data, etc.) and numbers and codes assigned to individuals which can identify individuals (passport numbers, national pension numbers, insurance card numbers, driver's license numbers and various insurance card numbers, etc.).
  2. Personal Data means Customers’ Personal Information handled by the Company which has been organized so as to be able to search for a particular individual and information which can be retrieved via computers using the retrieval function or which is kept in a manner so as to be able to easily search for particular Personal Information in accordance with certain laws and regulations.
  3. Retained Personal Data means Customers’ Personal Data handled by the Company which is prepared and organized by the Company itself and over which the Company has the authority to disclose or correct the content thereof. Provided, however, this does not include data prescribed in laws and regulations.

2. Method of Acquisition of Personal Information

The Company shall acquire Customers’ Personal Information through lawful and fair means.

3. Use of Personal Information

  1. Unless otherwise provided for in laws and regulations, the Company shall, when provided with Personal Information by Customers, clearly state the purpose of use thereof in advance. For details on the purpose of use, please see 1. "Purpose of Use of Personal Information" in the Matters to be Publicly Disclosed attached hereto.
  2. Unless otherwise provided for in laws and regulations, the Company shall only use Personal Information provided by Customers within the scope of the purpose of use clearly stated in advance, and only to the extent required to perform services.

4. Joint Use of Personal Data and Entrustment of Business

The Company may, in order to perform its services, jointly use Personal Data with and between the Company (including the Group companies), its franchisees and business alliance partners and/or entrust the handling thereof to a third party in accordance with the terms of 2. "Joint Use of Personal Information" in Matters to be Publicly Disclosed attached hereto. In this case, the Company shall properly monitor said third party to ensure the strict handling of Customers’ Personal Information.

5. Provision of Personal Data to Third Parties

Unless otherwise provided for in laws and regulations, etc., the Company shall not provide or disclose a Customer’s Personal Data to third parties without obtaining the prior consent of the Customer.

6. Security Control Measures for Retained Personal Data

The Company shall protect and manage Customers’ Personal Information retained thereby by implementing reasonable and appropriate security measures in terms of its organizational systems and information and telecommunications technology as well as by implementing general anti-crime measures.

7. Disclosure, Correction and Suspension of Use, etc. of Retained Personal Data

The Company acknowledges that Customers have the right to request for the disclosure, correction and suspension of use, etc. of their own Retained Personal Data and if it receives a request therefor, it shall respond thereto without delay in accordance with laws and regulations. Provided, however, the Company may refuse to accept requests for the deletion or erasure of a Customer’s Personal Data retained by the Company in its entirety in the following cases.

  1. It obstructs the performance of agreements, the provision, etc. of after-services or the performance of the Company’s services
  2. It obstructs the Company from fulfilling its duty to retain documents prescribed under law

8. Public Disclosure of and Revisions to the Policy

This Policy shall be publicly disclosed on the Company’s website (http://www.starts.co.jp/). In addition, a printed version of this Policy shall be made available at the head office and each of the other offices at all times. This Policy may be revised as necessary. (The latest information shall be posted on the website.)

9. Requests and Inquiries Concerning Personal Information

The Company shall appoint an officer to act as the Personal Information Protection Administrator and be in charge of protecting and appropriately managing Personal Information and shall further enhance the protection and management of Personal Information by specifically designating the General Affairs Department to be the department in charge thereof.

Matters to be Publicly Disclosed (Appendix to the Privacy Policy)

1. Purpose of Use of Personal Information

The Starts Group operates various businesses aimed at assisting our Customers to lead a better life and we shall use our Customers’ Personal Information appropriately within the scope required for the performance of such businesses. The purpose of use of Personal Information is as described in (1) below.

    6. Operation of Starts Group’s membership service
    7. Any and all matters incidental to any of the purposes mentioned above

2. Joint Use of Personal Information

Starts Group shall jointly use any customer information obtained by the Company’s group companies, companies with which the Company has executed franchise agreements and companies with which it has formed business alliances with and between such companies within the scope described in "1. Purpose of Use of Personal Information" above in order to efficiently provide comprehensive services to our Customers in order to assist them in leading a better life. Each company jointly using the customer information shall be liable for its own use thereof, however, Starts Corporation Inc. shall be the company held liable and be jointly and severally liable for the joint use of those companies.

    Customers’ names, gender, addresses, dates of birth, telephone numbers, fax numbers, e-mail addresses, place of work, family status, contract details, details of leased property, various ID numbers, portfolio assets and purchased insurances as well as other matters deemed necessary to achieve the purpose of use above. However, this shall be limited to the minimum items required therefor.

3. Handling of Personal Information on the Company Website

  1. Customers can view most products and services as well as the Company’s profile without providing their Personal Information when they access the Company’s website. Provided, however, Customers may need to provide their Personal Information in the following cases. In these cases, information shall be protected and handled in accordance with the Company’s "Privacy Policy".
    1. When requesting or inquiring into materials on the Company’s products and services or the Company’s brochures, etc.
    2. When booking or inquiring into any of the Company’s facilities, etc.
    3. When using any specific services (subscription to e-mail newsletters or membership to the Friendship Society, etc.)
    4. When applying for or participating in any campaigns or events
    5. When answering questionnaires, etc.
  2. The Company shall not be liable in any way for the handling of Customers’ Personal Information on any third-party websites linked to from the Company’s website. Please confirm the privacy policies and notes of the linked websites.
  3. Cookies
    Some pages on the Company’s website use "Cookies" which collect Customers’ browsing histories to allow them more convenient use of the Company’s website and to provide services thereto as well as for the purpose of conducting user analysis and placing advertisements, etc. on the web. A cookie is a text file which identifies a Customer’s computer on websites and is a serial number transmitted from the web server and stored on the Customer’s computer. Cookies do not contain Personal Information. Customers may set their browsers to block cookies if they wish. Customers will still be able to use the Company’s website even if they have blocked cookies, but may be unable to use some of the functions. The Company may store and consult "cookies" via a third party under a service entrustment agreement with a third party to whom the Company entrusts distribution of advertisements.

4. Various Requests Concerning Retained Personal Information

The Company shall respond to any requests made for disclosure, correction, suspension of use, erasure and various other requests concerning retained Personal Information as follows:

  2. Times During which Requests are Handled and Method of Request
    The Company shall accept requests made by post, in person at the Company, by telephone or by e-mail during the Company’s business days from 9:00 a.m. to 6:00 p.m., at the contact desk above. In this case, customers shall agree to " (3) Agreed Matters" below. We may not be able to accept a Customer’s request if s/he does not agree thereto.
  3. Agreed Matters
    When making a request to the Company, Customers shall cooperate with the following.
    1. Fill in the request form in the format prescribed by the Company;
    2. Verify their identities by presenting their driver’s license, passport or other identification issued by governmental agencies bearing a photograph of their face (copies not accepted);
    3. If the request is made by a proxy rather than by the Customer him/herself, verify the identification of their proxy and the documents evidencing the authority of proxy (such as a letter of proxy affixed with the Customer’s registered seal and a certificate of the Customer’s registered seal);
    4. Hold an interview with the Company’s personnel;
    5. Note that it may take a considerable number of days after receiving the request for the Company to extract the relevant Personal Information and to prepare appropriate measures, responses and explanations;
    6. Note that, no handling charge will be incurred for requests which have been properly prepared with documents to verify the identity, etc. of the person making the request as long as they require only general verification, a response to the request and the preparation of a report for the request. Provided, however, reasonable handling fees, etc. may be charged to cover actual expenses incurred for requests exceeding the scope mentioned above or which require special handling, etc.;
    7. Upon a request being made, the Company shall store and manage the submitted request form and attached documents (such as identification, etc.), as a record of your request.
